1. About this agreement

These Terms of Service ("Terms") form a legally binding agreement between you ("you" or "User") and Tomas Sniukas, operating as an individual sole proprietor based in Lithuania ("we," "us," "our," or "PeptideMonitor"), regarding your access to and use of the PeptideMonitor mobile application, website at peptidemonitor.app, and all related services (together, the "Service").

By creating an account, installing the app, or otherwise accessing the Service, you confirm that you have read, understood, and accepted these Terms together with our Privacy Policy, which is incorporated into this agreement by reference.

If you do not agree to these Terms, do not use the Service.

2. What PeptideMonitor is

PeptideMonitor is a personal tracking tool for people following self-directed supplementation protocols. The Service allows you to:

PeptideMonitor offers both free features and premium features that require a paid subscription. Premium features include advanced statistical analysis, causal-inference insights between protocols and biometrics, lab and DEXA document parsing, body composition tracking, and side-effect frequency data from clinical trials.

The Service is provided for personal informational and self-tracking purposes only.

3. What PeptideMonitor is not

PeptideMonitor is not a medical device, not a healthcare service, not a pharmacy, and not a source of medical advice.

3.1 Not medical advice

Nothing in the Service — including any chart, statistic, correlation, text, or suggestion — constitutes medical advice, diagnosis, treatment recommendation, or prescription. The Service is not a substitute for consultation with a qualified, licensed healthcare professional who knows your individual medical history.

3.2 Always consult a professional

You should always consult a qualified physician, pharmacist, or other licensed healthcare professional before beginning, modifying, or discontinuing any supplement, peptide, or medication regimen. Never disregard or delay professional medical advice because of anything you see or read in PeptideMonitor.

3.3 Emergencies

PeptideMonitor is not intended for use in medical emergencies. If you believe you are experiencing a medical emergency, contact your local emergency services immediately. In the European Union, dial 112. In the United States, dial 911.

3.4 No professional relationship

Use of the Service does not create any doctor-patient, provider-patient, pharmacist-client, advisor-client, or other professional healthcare relationship between you and PeptideMonitor.

3.5 Jurisdiction and legality

Laws governing peptides, supplements, and related compounds vary substantially by country and region. You are solely responsible for understanding and complying with all laws applicable to your possession, use, acquisition, or importation of any compound. PeptideMonitor makes no representation that any compound you log or track is legal in your jurisdiction.

3.6 Not a pharmacy or retailer

PeptideMonitor does not sell, supply, distribute, recommend specific vendors for, or arrange purchases of any compound, peptide, supplement, medication, or medical device. The Service is a tracking tool for substances you obtain independently.

3.7 Analytical limitations

The statistical analyses, correlations, effect sizes, confidence intervals, and other quantitative outputs produced by the Service are based on the data you enter and data received from connected wearables. These outputs:

3.8 Regulatory status

PeptideMonitor is not a medical device under EU Regulation 2017/745 (MDR), is not regulated by the European Medicines Agency, and is not cleared or approved by the U.S. Food and Drug Administration. The Service is not intended to diagnose, treat, cure, or prevent any disease.

4. Eligibility and accounts

4.1 Age requirement

You must be at least 18 years of age to create an account or use the Service. By using PeptideMonitor you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

You agree to provide accurate, current, and complete information when creating your account and to keep your account information up to date. You are responsible for all activity that occurs under your account.

4.3 Account security

4.4 One account per person

You may not create multiple accounts for personal use, share your account with others, or allow others to use your account.

5. Acceptable use

5.1 What you may do

Within the scope of these Terms, you may:

5.2 What you must not do

You agree not to:

6. Subscriptions and billing

6.1 Free tier and Pro tier

PeptideMonitor offers two tiers:

Free tier is available without payment and includes:

Pro tier is a paid subscription that unlocks:

6.2 Pricing

Subscription pricing varies by region and currency. Current prices are displayed in the App Store before purchase and on the in-app paywall. Annual subscriptions are offered at a discounted rate compared to twelve months of monthly subscription.

6.3 Free trial

New Pro tier subscriptions include a 14-day free trial. To start the trial:

You can cancel during the trial through your Apple ID account settings. A trial may only be used once per Apple ID.

6.4 Billing via Apple

Subscriptions purchased through the iOS app are billed by Apple through your Apple ID account under the terms of the Apple Media Services agreement. Payment is charged to your Apple ID at confirmation of purchase (after the trial period, if applicable). You manage your subscription, including cancellation and renewal settings, through your Apple ID account settings.

6.5 Automatic renewal

Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your payment method will be charged for renewal within 24 hours of the renewal date.

6.6 Refunds

All subscription fees are charged and handled by Apple. Refund requests for subscriptions purchased through the App Store are governed by Apple's refund policy and must be submitted to Apple directly at reportaproblem.apple.com. We do not process refunds for App Store purchases.

Where applicable EU consumer protection law grants you a statutory right of withdrawal, you may exercise that right by contacting us at the email listed in section 17. Note that starting to use a paid feature typically constitutes consent to begin the service immediately and may waive this right under EU Directive 2011/83/EU, Article 16(m).

6.7 Price changes

We may change subscription prices from time to time. Price changes will not apply to any period you have already paid for. You will be notified of any price change before your next renewal, with a reasonable opportunity to cancel.

6.8 Family Sharing

PeptideMonitor subscriptions are not enabled for Apple Family Sharing. Each user must hold their own subscription.

6.9 Subscription pause

PeptideMonitor does not currently offer subscription pause. To stop billing, cancel your subscription through your Apple ID; you may resubscribe at any time.

7. Third-party integrations

7.1 Wearable and device integrations

PeptideMonitor currently integrates with Apple HealthKit, WHOOP, and Oura. When you connect such a service, you authorize PeptideMonitor to request and receive data from that service on your behalf, within the scope of the permissions you grant during the connection flow.

The current list of supported integrations is shown in the Wearables screen within the app. We do not have plans to add other wearable integrations.

7.2 Third-party terms apply

Your use of any third-party service remains subject to that service's own terms and privacy policy. PeptideMonitor is not responsible for the availability, accuracy, or behavior of third-party services.

7.3 Disconnection

You may disconnect any third-party integration at any time through the app's settings. Biometric data previously imported will remain in your account unless you delete it separately.

7.4 No endorsement

The availability of an integration does not constitute endorsement of the third-party product or service by PeptideMonitor.

8. Your data and content

8.1 Ownership

You retain full ownership of the data you submit to the Service, including your compound logs, biometric data, lab and DEXA results, photos, and any notes. Nothing in these Terms transfers ownership of your data to us.

8.2 Limited license to us

You grant us a limited, non-exclusive, non-transferable, royalty-free license to host, store, copy, process, transmit, and display your data solely as needed to operate the Service, provide the features you use, and comply with our legal obligations. This license ends when you delete your data, except where we are required to retain copies by law.

8.3 Aggregate and anonymized data

We may generate aggregated and fully anonymized data from usage patterns on the Service (for example, statistical distributions of popular compounds or general app performance metrics). Such data does not identify you and may be used indefinitely for product improvement and research.

8.4 Privacy

Our collection and use of your personal data is described in our Privacy Policy. If you are in the European Economic Area, the United Kingdom, or Switzerland, the Privacy Policy describes your rights under the EU General Data Protection Regulation (GDPR) and equivalent laws, including your rights to access, rectification, erasure, restriction, portability, and objection.

8.5 Data export

You may export your data at any time through the app's settings or by contacting us at the email listed in section 17.

9. Intellectual property

9.1 Our rights

The Service, including its software, design, user interface, text, graphics, logos, trademarks, and all associated intellectual property, is owned by PeptideMonitor or its licensors and is protected by copyright, trademark, and other laws. The PeptideMonitor name, logo, and mark are trademarks of PeptideMonitor.

9.2 Limited license to you

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the PeptideMonitor app on a device you own or control for personal, non-commercial purposes.

9.3 Restrictions

You may not copy, modify, distribute, sell, lease, sublicense, publicly display, or create derivative works of any part of the Service, except as expressly permitted by these Terms or applicable law that cannot be overridden by agreement.

9.4 Feedback

If you send us ideas, suggestions, feature requests, or other feedback, we may use that feedback freely, without obligation to you, for any purpose including improving the Service.

10. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, non-infringement, and uninterrupted operation.

Without limiting the above, we do not warrant that:

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot be excluded or limited under applicable law, including consumer protection law. If you are a consumer in the European Union, your statutory rights under Directive 2019/771 and local implementing law are not affected by this section.

11. Limitation of liability

To the fullest extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or relating to your use of the Service.

This includes, but is not limited to, damages for loss of profits, revenue, data, goodwill, or other intangible losses, regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and regardless of whether we were advised of the possibility of such damages.

Our total cumulative liability to you for all claims arising out of or relating to these Terms or the Service is limited to the greater of: (a) the total amount you paid to us (or to Apple on our behalf) for the Service in the twelve months immediately preceding the claim, or (b) one hundred U.S. dollars ($100 USD) or its equivalent in your local currency.

If you are a consumer in the European Union, the above limitations do not affect your statutory rights that cannot be excluded or limited under mandatory consumer protection law, and do not apply to liability for death, personal injury, gross negligence, or intentional misconduct.

12. Indemnification

You agree to defend, indemnify, and hold harmless PeptideMonitor and its affiliates, contractors, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

13. Suspension and termination

13.1 Termination by you

You may stop using the Service and delete your account at any time through the app's settings. Deleting your account deletes your personal data in accordance with our Privacy Policy. Cancelling a paid subscription is handled through your Apple ID and takes effect at the end of your current billing period.

13.2 Termination or suspension by us

We may suspend or terminate your access to the Service at any time, with or without prior notice, if we reasonably believe that:

Where reasonable and lawful to do so, we will give notice before termination and an opportunity to remedy the issue.

13.3 Effect of termination

On termination, your right to use the Service ends immediately. Sections that by their nature survive termination will continue to apply, including those governing intellectual property, disclaimers, liability, indemnification, governing law, and general provisions.

14. Governing law and disputes

14.1 Governing law

These Terms and any dispute or claim arising out of them or their subject matter are governed by the laws of the Republic of Lithuania, without regard to its conflict-of-laws rules.

14.2 Consumer protection

If you are a consumer resident in the European Union, you benefit from any mandatory provisions of consumer protection law in your country of residence that cannot be derogated from by agreement. Nothing in this section deprives you of the protection of those mandatory provisions.

14.3 Courts

Disputes arising out of these Terms will be submitted to the exclusive jurisdiction of the courts of Vilnius, Lithuania, subject to your right as a consumer to bring proceedings in the courts of your country of residence under applicable law.

14.4 Online dispute resolution

If you are a consumer in the European Union, you may also submit disputes via the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14.5 Time limit

Any claim arising out of these Terms or the Service must be brought within one (1) year of the date the claim arose, except where a longer period is required by applicable law.

15. Apple App Store terms

If you access the Service through the Apple App Store, the following additional terms apply. These terms are required by Apple and govern our relationship with Apple as it relates to your use of the app.

15.1 Acknowledgement

These Terms are between you and PeptideMonitor only, and not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content.

15.2 Scope of license

The license granted to you for the app is limited to a non-transferable license to use the app on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions.

15.3 Maintenance and support

PeptideMonitor is solely responsible for any maintenance and support for the app, as specified in these Terms or as required by applicable law. Apple has no obligation to provide any maintenance or support services for the app.

15.4 Warranty

PeptideMonitor is solely responsible for any product warranties relating to the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever for the app.

15.5 Product claims

PeptideMonitor is responsible for addressing any claims from you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims under consumer protection, privacy, or similar legislation. Apple is not responsible for addressing such claims.

15.6 Intellectual property

In the event of any third-party claim that the app or your use of it infringes that third party's intellectual property rights, PeptideMonitor, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.

15.7 Legal compliance

You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

15.8 Third-party beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

16. Changes to these terms

We may update these Terms from time to time, for example to reflect changes in the Service, in law, or in our business. When we make material changes, we will update the "Effective" date at the top of this document and, where reasonable, notify you through the app or by email before the change takes effect.

Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of them. If you do not agree to the updated Terms, you should stop using the Service and, if you have a paid subscription, cancel it through your Apple ID.

17. Contact and legal notices

18. General provisions

18.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements or understandings on the same subject.

18.2 Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

18.3 No waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

18.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of substantially all of our assets.

18.5 Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, acts of war, civil unrest, internet outages, failures of third-party infrastructure (including Apple, Google, Supabase, RevenueCat, Mistral, WHOOP, or Oura), and governmental actions.
